We asked him:<\/p>\n
What is the humanitarian and social situation of children residing with their incarcerated mothers in Iraqi prisons, and what are the most important Iraqi legal provisions regulating the stay of these children, defining their rights and care conditions inside prisons?<\/p>\n
We have indicated in our reports from previous years that there are a large number of children with their families in prisons and Reformatories\u00a0 in Iraq without any legal provision authorising this, as the law permits the stay of two categories of children with their mothers in two cases:-
\n1- The first case is until the child reaches the age of three, in the best interest of the child, provided certain conditions are met regarding the mother and the place.
\n2- In the case of recent births or in the case of women sentenced to death, the execution of the death sentence is postponed until childbirth, and if the newborn is alive, it is postponed for two years, in accordance with the noble verse that prescribes two years for breastfeeding ( “Mothers shall breastfeed their children for two full years” ).<\/p>\n
But what we see now, and this is documented in our annual reports and investigative report No. (4) for the year 2023, which was about (The situation and rights of children accompanying their families in prisons and correctional facilities in Iraq).
\nFurthermore, we have indicated in our reports that the Prisoners’ Justice Network recorded in one of the correctional facilities in the Kurdistan Region of Iraq that the number of accompanying children was greater than the number of female detainees and convicts combined, with each mother keeping with her between (2 to 5) children.
\nWe also indicated that the law specified three years for the child’s age in the case of the mother being sentenced to a custodial penalty, and two years for the child born to a mother sentenced to death. However, what we observed was the presence of children at very advanced ages (eight years, nine years, up to twelve years).<\/p>\n
What is the reality of children living with their mothers inside Iraqi prisons? And what are the most prominent Iraqi laws and legislation regulating their presence and care within these institutions?<\/p>\n
The reality of life for these children is very bitter; they are deprived of everything that children their age enjoy, from a healthy environment to sports, to sunlight exposure, to play, to cleanliness, to education, to social interaction, to playing with their peers, to food, to health, to upbringing, etc.<\/p>\n
Regarding legislation, we have previously explained the legal provisions that talk about age groups, reasons, and legal periods for children to stay with their families, but what we see today is not mentioned in any current law in Iraq.<\/p>\n
What can be done to address this situation?<\/p>\n
We met with members of the Iraqi Council of Representatives after the issuance of the special report on the situation of accompanying children and discussed the matter in more detail, and we proposed legal and humanitarian solutions to them, and they promised to work on this file, but two years have passed without any action, and the situation remains as it was in previous years.<\/p>\n
The solutions were:-
\n1- Adhering to what is stipulated in current laws regarding children (children of mothers sentenced to custodial penalties and children of mothers sentenced to death) and not allowing others to remain in prisons and correctional facilities for any reason.
\n2- Building shelters to place children who do not have relatives to receive them.
\n3- Attempting to reduce custodial penalties and replace them with financial fines whenever possible for the benefit of the child.<\/p>\n
I have mentioned the situation of accompanying children in many reports, in addition to the reports of’ Justice Network for\u00a0the Prisoners the report of the High Commission for Human Rights, the report of the Independent Human Rights Commission, the reports of the Public Prosecution, the reports of United Nations agencies, the reports of non-governmental organisations, and media reports.
\nBut the situation has remained as it is, and no one has taken any action to this day.<\/p>\n
